This Instruction Memorandum (IM) outlines the Bureau of Land Management (BLM) policy and procedures for delaying full implementation of 43 Code of Federal Regulations (CFR) 3173 as it relates to electronic filing requirements for Facility Measurement Points (FMP) and site facility diagrams, and 43 CFR 3174 as it relates to permanent oil measurement facilities installed before January 17, 2017.

The Mineral Leasing Act requires the BLM to ensure that operators “use all reasonable precautions to prevent waste of oil or gas.”  This rule applies to all onshore Federal and Indian (other than Osage Tribe) oil and gas leases, units, and communitized agreements (CA), as well as committed State or private tracts in a federal approved unit or CA. 

43 CFR 3175 replaces Onshore Order No. 5 and establishes minimum standards for accurate measurement and proper reporting of all gas removed or sold from Federal and Indian leases (except Osage Tribe), units, unit participating areas, and areas subject to communitization agreements.

This rule adjusts the level of civil monetary penalties contained in the Bureau of Land Management’s regulations governing onshore oil and gas operations as required by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (the ‘‘Act’’).

This rule amends the Office of Natural Resources Revenue (ONRR) civil penalty regulations by expanding the regulations to all Federal and Federally administered mineral leases on Indian Tribal and individual Indian mineral owners' lands, onshore and on the Outer Continental Shelf (OCS), and to all easements, rights of way, and other agreements on the OCS. This rule incorporates the civil penalty inflation adjustments under the Federal Civil Penalties Inflation Adjustment Act Improvemen Act.

Colorado Oil & Gas Docs

This Colorado Oil & Gas Conservation Commission Notice to Operators (NTO) requires all operators to inspect systematically their inventory of existing Flowlines to ensure and document integrity of all lines within 1,000 feet of a Building Unit. Operators must ensure inactive or abandoned lines comply with current COGCC Rule 1103. Operators must provide Flowline and pipeline inventory and location data to the COGCC.

COGCC is releasing the eForm 27 on January 1, 2017. All Form 27s will need to be submitted electronically from this point forward. The eForm 27 may be submitted to update or request closure on existing Remediation Projects.

New Mexico Oil & Gas Docs

Effective August 1, 2017, the Oil Conservation Division will no longer accept any other survey datum other than NAD83.

The Gas Capture Committee’s continuing evaluation of volumes being reported determined that not all Operators are following the requirement to report flared and vented volumes.

The Oil Conservation Division is posting a notice reminding operators of UIC wells who are considering the use of annular additives to seal wells in order to successfully conduct mechanical integrity tests. Please review the content of the notice. Failure to comply with the prohibition of these products in UIC wells shall result in the loss of injection authority.

Utah Oil & Gas Docs

Utah Oil and Gas is aiming to bring their new database and all associated applications online on or around June 1, 2017. They hope to avoid slowing your work or causing you any stress. There are a lot of moving parts involved, however, and great potential for problems. They'll try to fix problems and shortcomings as quickly as possible. One of the changes coming on June 1, 2017, will be a new program called 'eForm.'

DOGR is shooting to 'go live' with all eform systems on June 1, 2017. Operators will be able to enter their first reports via eForm beginning with the May 2017 report. This applies to Form 10, Form 11, Form 13A, Form 13B, UIC Form 2, and UIC Form 3.

The Utah Division of Oil, Gas and Mining will soon begin using a new oil and gas database. It will replace all of the Oil and Gas Program's current databases and will impact most of our electronic operations. Additional changes will be rolled out to oil and gas operators sometime during the next 6 to 12 weeks.

Some of the changes include:
           - The use of 14-digit API numbers.
           - The collection of more detailed wellbore information.
           - A few modifications to our ePermit permitting program.
           - The replacement of our eReport program for monthly production, gas plant, and UIC reporting.
           - Changes to our website, including some LiveData Search functionality.
           - The addition of a web data mining tool and map (which will replace our current well locator map).
           - The installation of new servers.

Rule R649-8-21 requires that operators of disposal wells, storage wells, or enhanced recovery projects submit UIC Form 4, Annual Fluid Injection Report, within 60 days following the end of the year. Rule R649-5-5 requires that the fluids injected into each disposal well or project be sampled and analyzed no less frequently than once a year and a copy of the analysis be submitted with UIC Form 4.

Rule R649-9-2.4 requires that all operators submit an Annual Waste Management Plan to account for the disposition of produced water and other E&P wastes.

The Utah Board of Oil, Gas and Mining, on October 26, 2016, approved changes to rule R649-3-32, Incident Reporting. The effective date of the changes is November 1, 2016. Rule R649-3-32 pertains to the reporting of events involving such things as accidents, injuries, fatalities, fires, blowouts, loss of control of wells, and the unauthorized release of oil and natural gas-related product, by-product, or waste through flaring, venting, and spills.
